Terms & Conditions*
- 1. I acknowledge receiving the Dog's medical records and agree to take the Dog and these medical records to a licensed veterinarian within the first 30 days after execution of this Adoption Contract.
- 2. IF AN EMERGENCY VET VISIT is needed within the first 7 days of ownership, I will contact RMCR and they will email the Dog’s complete medical history to the ER Vet Clinic of my choice.
- 3. I agree not to sell nor dispose of the Dog except humane euthanasia performed by a licensed Veterinarian for medical/health reasons and will notify RMCR upon his/her death.
- 4. I understand RMCR will add my contact info to the national microchip registry. I agree not to remove or alter RMCR's contact info as secondary contact and will update the registry with my personal info as needed. I agree to notify RMCR immediately if the Dog is lost or stolen.
- 5. I agree the Dog will not be used for illegal purposes and will not debark, defang, or crop the ears or tail of the Dog for any non-medical reason. I agree the Dog will not be trained as a guard dog nor participate in dog fighting events. I affirm that no member of my household has been convicted or charged with any animal welfare law violation such as hoarding, unsanitary conditions, neglect, cruelty, abandonment, etc.
- 6. I understand and agree the Dog is placed as a pet, with no warranty as to the quality, physical condition, breed, training, health or temperament of the Dog. I shall comply with all applicable local ordinances and state statutes regarding ownership of the Dog, including necessary vaccinations, licensing and leash laws. I agree not to tie up or chain the Dog nor allow it to ride uncaged in the back of a pick-up truck or open vehicle.
- 7. I agree to provide veterinary care and shall not seek reimbursement from RMCR with the understanding that I assume all risk and responsibility for the Dog's actions, health, temperament and financial needs after adoption. Furthermore, RMCR has disclosed all medical records and findings to the best of their ability, but cannot certify to the completeness or accuracy of ALL documentation. I accept full financial responsibility for veterinarian and medical costs after adoption of the Dog.
- 8. I agree to contact RMCR if I need guidance or assistance transitioning the Dog into my home. I understand that follow-up emails or calls by RMCR representatives will occur and I will respond.
- 9. I understand RMCR is regulated by the Colo Dep't of Agriculture’s Pet Animal Care and Facilities Act (PACFA) Program and that I received the PACFA sponsored Rabies Prevention brochure by email, which occurred during the adoption application process. https://ag.colorado.gov/ICS/PACFA, 303-869-9146
- 10. If I breach any agreement contained in this Adoption Contract, I understand ownership of the Dog may revert to RMCR and RMCR shall rescind this Adoption Contract and demand return of the Dog. Should I fail to return the Dog, RMCR may seek a court order against me/us for the return of the Dog to include liquidated damages in the amount of $1,500 and any sum paid for Dog pursuant to this Adoption Contract plus attorney's fees and court costs.
- 11. RMCR shall not be responsible for any damages, losses, or other injuries to persons, pet, or real or personal property occurring during the process of dog adoption. I agree to indemnify and hold harmless RMCR, its principals, agents, officers, directors, members, employees, representatives, agents, volunteers, other foster parents, and assigns, past or present, (“the Releasees”) for any loss suffered as an Adopter.
- 12. I understand, promises, and agree they and each forever release, discharge and covenant to hold harmless RMCR and any other person, firm, or organization charged or chargeable with responsibility or liability, their heirs, administrators, executors, successors, and assigns from any and all claims, damages, costs, expenses, loss of services, actions, and causes of action belonging to Adopter, or to any other person or entity, arising out of any act or occurrence from the present time and particularly on account of the conduct, actions, adoption and/or recovery by RMCR.
- 13. Despite the Waiver of Liability provisions, if I bring legal action against any of the Releasees for any loss, I shall pay the costs, including attorneys’ fees, incurred in defending any such action.
- TEMPORARY STERILIZATION WAIVER (TSW): All items below apply only to persons ADOPTING A DOG PRIOR TO SPAY/NEUTER, however your check mark is still needed in order to complete this contract. This waiver is only for dogs whose life or health is adversely affected at the time of adoption, according to a licensed veterinarian. .
- A. I acknowledge the Dog is not sterilized and has an approved TSW, therefore I will donate $450 (non-refundable) in the name of the Dog to be used at a later date towards the cost of the Dog's sterilization surgery, aka spay/neuter.
- B. After the Dog has been medically cleared for sterilization (but not prior to 6 months of age), I agree to 1. contact RMCR, 2. select an approved veterinarian/clinic and 3. schedule sterilization surgery at my convenience. RMCR agrees to pay for the sterilization surgery, any 'cones of shame', and pain medication needed for recovery. RMCR shall not be responsible for costs not associated directly with the sterilization surgery.
- C. I agree to follow the discharge instructions provided by the veterinarian. I understand that if I choose other than an RMCR approved facility, I am financially responsible for all costs associated with the sterilization surgery.
- D. I agree to comply and properly communicate with RMCR regarding the date of the sterilization surgery and/or proof of sterilization, it is a violation of Item 10 of this Adoption Contract.
